TERMS & CONDITIONS
Master Customer Policy • September 2026
Effective Date: September 2026
Please review these Terms & Conditions before placing an order, approving a proof, submitting a custom request, or purchasing from T & K Designs and Services. These terms are intended to create a clear, fair process for customers and staff.
1. Orders, Custom Requests, Proofs & Approval
Our products may be custom-made, personalized, ready-made, or produced to customer specifications. Customers are responsible for providing complete and accurate order information, including names, spelling, dates, sizes, product selections, photos, logos, colors, placement instructions, and other requested details.
Full payment is required before T & K begins custom design and proof preparation for a custom product order. Payment authorizes T & K to begin the design and proof process but does not constitute design approval. Production begins only after the customer provides final proof approval.
Unless otherwise stated in writing, one proof and one revision are included with a custom order. Additional revisions, redesigns, or changes in scope may require an additional fee.
Customers must review proofs carefully. Final approval confirms that the customer has reviewed and accepted the design, including spelling, wording, photos, placement, colors, sizing, and other visible details. No changes may be made after the final design has been approved unless T & K agrees in writing and any applicable additional fees are paid.
Submitting a customization request, quote request, website design, or order inquiry does not start production. For custom product orders, payment must be received before design and proof preparation begins. Production begins only after T & K has received all required information and final proof approval.
2. Quotes, Quote Fees & Quote Validity
A quote fee may apply when T & K prepares a custom quote. The amount and terms of the quote fee will be communicated before the quote is prepared.
If the customer places the applicable order within the quote validity period, the quote fee may be credited toward that order as stated by T & K. If the customer does not proceed with the order, the quote fee is non-refundable.
Unless a different period is stated in writing, quotes are valid for 30 calendar days from the date issued. After the validity period expires, pricing, materials, availability, production requirements, and other costs are not guaranteed. A new quote and a new quote fee may be required.
Quotes, quote fees, project pricing, and related rights are non-transferable unless T & K expressly agrees in writing. They apply only to the original customer and the specific project for which they were issued.
3. Design Creation Fees, Design Licensing & Ownership
T & K separates the fee for creating a design from the right to receive or own a digital design file. Payment of a design creation fee compensates T & K for the time, skill, and creative work required to develop the design. A design creation fee is non-refundable and does not, by itself, purchase or transfer the design.
Design proofs may contain a T & K watermark and are provided for review and approval only. Watermarks will not appear on physical products produced by T & K.
Design projects may follow one of three structures: (1) Design Creation Fee Only — the customer pays for design work, but no unwatermarked digital design file is released; (2) Design Creation Plus Final Design License Included — when the written quote or order expressly includes a final design license, the agreed unwatermarked final file may be released after final approval and payment in full; or (3) Design Creation Plus Separate Final Design License — after approval, the customer may be offered the opportunity to purchase the agreed final design file for an additional fee.
If the customer does not purchase or otherwise receive a final design license, the customer may still order products from T & K using the approved design, but the customer does not receive the unwatermarked digital file.
T & K retains ownership of its original artwork, design concepts, working files, templates, and editable/source files unless full ownership or specific rights are expressly transferred in a written agreement and all applicable fees are paid.
Design rights and licenses are non-transferable to another person, business, organization, or unrelated project unless T & K expressly authorizes the transfer in writing.
4. Inactive Design & Custom Projects; File Retention
A design or custom project that remains inactive for 60 calendar days or more may be closed. Inactivity may include failure to respond, approve, provide required information, or proceed with the project.
T & K does not guarantee indefinite retention of unfinished designs, proofs, customer uploads, project files, or working files. Restarting a closed project may require a new quote, new design fee, or other applicable fees.
When a customer purchases and receives a final digital design file, the customer is responsible for saving and maintaining their copy. T & K does not guarantee permanent storage or future replacement of delivered files.
5. Payment & Production Authorization
For custom product orders, full payment must be received and confirmed before T & K begins custom design and proof preparation, unless T & K expressly agrees otherwise in writing. Payment does not constitute design approval. Production begins only after final proof approval.
Available payment methods may include card payments and approved manual payment methods. When manual payment instructions are provided, customers must follow the instructions and include the requested order, quote, or reference number. Payment is not considered received until T & K confirms it.
Non-payment or delayed payment may delay, suspend, or prevent custom design, proof preparation, or production. Fees identified as non-refundable remain non-refundable.
6. Production Times, Event Dates & Rush Requests
Production times vary by product, order volume, customization, material availability, and complexity. Any completion timeframe is an estimate unless a specific completion date is expressly confirmed in writing by T & K.
Production time begins only after all required information and final proof approval are received. Payment for custom product orders is required before design and proof preparation begins. Delays caused by missing information, late approvals, customer changes, or circumstances outside of T & K's reasonable control may extend completion time.
Customers ordering for a birthday, event, show, holiday, deadline, or other date-specific purpose must provide the required date before production. T & K must confirm whether the requested date is feasible. Rush service, when available, may require an additional fee.
7. Customer-Provided Photos, Logos, Artwork & Content
Customers are responsible for the content they submit and represent that they have the rights, licenses, consent, or permission necessary for T & K to use that content to fulfill the order.
T & K may decline or stop work involving content that appears to violate intellectual-property rights, privacy rights, applicable law, or T & K standards.
Customers are responsible for the quality of files they provide. T & K may identify or warn about low-resolution, blurry, cropped, distorted, or otherwise limited files. If the customer elects to proceed after a quality concern is identified, limitations caused by the supplied file are not considered a T & K production error.
T & K may make reasonable technical adjustments necessary for production, including sizing, positioning, background removal, color preparation, or file-format adjustments, with customer approval when appropriate.
8. Handcrafted & Customized Product Variations
Many T & K products are individually customized, decorated, sublimated, printed, assembled, or finished. Minor variations may occur between a digital proof, website image, sample, mockup, and the final physical product.
Reasonable variations in color, placement, texture, finish, print appearance, monitor or screen display, material, or other normal production characteristics are not considered defects or T & K errors. A clearly incorrect color, product, image, wording, or other material departure from the approved proof may qualify as a T & K error.
9. T & K Error Standard & Production Defects
A T & K error generally means that the completed product materially fails to match the customer's final approved proof or confirmed order because of an error made by T & K. Examples may include T & K producing the wrong spelling, wrong photo, wrong product, wrong confirmed size, omitting an approved element, or creating a qualifying production defect during T & K's production process.
Customer-provided mistakes and customer-approved mistakes are not T & K errors. Reasonable production and color variations are not T & K errors.
T & K will review each reported issue using the order information, approved proof, production records, photographs, physical item when requested, and other relevant documentation.
10. Returns, Refunds, Exchanges, Cancellations & Remedies
Our custom and personalized products are made for the individual customer. Custom and personalized sales are final. T & K does not accept returns, refunds, or exchanges for customer-provided or customer-approved errors, preference changes, or other issues that do not qualify under these terms.
If T & K confirms a qualifying T & K error or production defect, T & K will determine an appropriate remedy consistent with these terms and applicable law. A remedy may include correction, reprint, replacement, adjustment, or another appropriate resolution.
Customers must inspect their order and report a claimed T & K error, damage, or production issue within 3 calendar days of pickup or delivery.
The original product must be retained while a claim is reviewed. T & K may request photographs, additional information, or surrender/return of the original item before providing a correction or replacement. For shipping-damage claims, the customer must also retain the original packaging and packing materials.
Orders cannot be canceled once production has begun unless T & K agrees otherwise. Non-refundable quote, design, rush, or other identified fees remain non-refundable.
T & K may, in its discretion, offer a courtesy replacement, credit, adjustment, or other accommodation in a situation that does not otherwise qualify. Any courtesy resolution is considered individually and does not establish a precedent or modify these Terms & Conditions.
11. Local Pickup & Unclaimed Orders
Customers who select local pickup will be notified when their order is ready. Unless otherwise stated, T & K will hold a completed local-pickup order for 30 calendar days from the initial ready notification.
T & K may send reminder notices around 7 days, 21 days, and before the end of the 30-day period. Customers remain responsible for collecting their orders within the pickup period.
Failure to pick up an order does not qualify the customer for a refund. After 30 calendar days and reasonable attempts to notify the customer, an unclaimed order may be treated as abandoned and may be disposed of, donated, or otherwise handled at T & K's discretion. T & K is not required to reproduce an abandoned order.
12. Shipping, Delivery, Address Errors & Transit Damage
Customers are responsible for providing a complete and accurate shipping address. If an order is returned because of an incorrect or incomplete customer-provided address, failure to retrieve the shipment, or another customer-related delivery issue, additional shipping charges may apply before the order is resent.
If T & K sends an order to an address different from the address properly provided by the customer, T & K will treat that as a T & K error and review the appropriate correction.
T & K takes reasonable care to inspect and package orders for shipment. Once a shipment is in transit, carrier timing and handling may be outside T & K's direct control. Transit damage is not automatically considered a T & K production error; however, T & K will review reported damage and may assist with carrier information or claims as appropriate.
If tracking reflects delivery but the customer cannot locate the package, T & K may assist with available tracking or carrier information, but a carrier-confirmed delivery is not automatically considered a T & K production error.
Shipping damage must be reported within 3 calendar days of delivery. The customer must retain the damaged item, original packaging, and packing materials and provide photographs or other information requested for review.
13. Events, Pop-Up Shops, Vendor Shows & Same-Day Service
T & K may offer ready-made products, custom ordering, personalization, pickup, and/or same-day service at car shows, school events, vendor shows, pop-up shops, and other events.
Same-day customization is not guaranteed. T & K may limit or close the same-day queue, move an order to later pickup, or offer shipping depending on order volume, production capacity, event conditions, safety, or other operational needs.
Event-specific pricing, bundles, promotions, products, and availability may differ from website or regular pricing.
When a customer is notified that an event order is ready for pickup, the customer is responsible for retrieving the order. If the customer leaves the event without collecting a completed order, T & K is not responsible for the customer's failure to retrieve it. When feasible, T & K may offer later local pickup or shipping at the customer's cost. Any order moved to later pickup is then subject to T & K's standard pickup policy.
Customer-Caused Damage or Loss. Customers and event guests are expected to handle T & K merchandise, displays, equipment, and booth property with reasonable care. If a customer or guest causes damage or loss beyond normal handling, T & K may document the incident and, when appropriate, seek reasonable reimbursement for the damaged or lost property consistent with applicable law.
Event Premises and Third-Party Conditions. T & K does not control the event venue, parking areas, walkways outside its booth space, other vendors, event organizers, other attendees, weather conditions, or other third-party areas or conditions outside T & K's reasonable control. T & K is not responsible for incidents arising solely from conditions outside its reasonable control, subject to applicable law.
Event Safety and Reasonable Care. T & K takes reasonable care in setting up, maintaining, and operating its booth and display area to promote a safe environment. Customers and guests are expected to use reasonable care while visiting the booth and to follow event or staff safety directions. Nothing in this section excludes responsibility that cannot legally be limited or waived.
14. Product Information, Fit, Use & Care
Customers are responsible for reviewing available product descriptions, dimensions, sizes, features, intended use, and other relevant product information before ordering.
T & K is not responsible for subjective preferences regarding fit, feel, grip, size, weight, heat, cold, texture, capacity, or other normal characteristics of a product when the product is otherwise as described and functioning as intended.
Customers are responsible for using products appropriately and following applicable care and safety instructions. T & K is not responsible for damage or injury caused by misuse, improper care, unauthorized modification, or use contrary to applicable instructions. Nothing in this section eliminates responsibility for a verified T & K production error or any responsibility that cannot legally be waived.
15. Website, Catalog, Mockup, Pricing & Availability Information
T & K makes reasonable efforts to keep website, catalog, product, mockup, pricing, description, and availability information accurate. Product photographs and mockups are representations and may not perfectly reflect the final physical product because of screen settings, materials, production methods, customization, and normal variations.
Products, materials, specifications, services, prices, promotions, and availability may change. T & K may correct genuine typographical, pricing, description, technical, or other inadvertent errors when identified.
When a material error affects an order or transaction, T & K will use reasonable discretion to determine an appropriate resolution, which may include correction, adjustment, customer contact, cancellation, or another lawful resolution. The appropriate response is determined by T & K based on the circumstances and applicable law.
16. Portfolio, Photography & Marketing Use
T & K may photograph completed work for portfolio, gallery, educational, social-media, or marketing purposes. T & K will not intentionally display private customer information in promotional content.
When an order contains personal photographs, children's images, sensitive information, or other content for which public use may reasonably require additional care, T & K may request permission before public use. Customers may also request that their order not be used for marketing.
Any internal staff process for documenting marketing permission does not alter the customer's ownership rights in customer-provided content.
17. Privacy & Order Communications
T & K uses customer information as reasonably necessary to process orders, provide customer service, fulfill and ship purchases, communicate about projects, operate the business, and comply with applicable requirements.
T & K does not sell customer personal information. Information may be shared with service providers such as payment processors, shipping carriers, website providers, or other vendors when reasonably necessary to provide the requested service.
By placing an order, requesting a quote, submitting a customization request, or otherwise beginning a project, the customer agrees that T & K may contact them regarding that order, quote, proof, payment, pickup, shipping, or related service matters.
18. Customer Concerns, Complaints & Escalation
T & K takes customer concerns and complaints seriously and aims to review them respectfully, consistently, and in accordance with these Terms & Conditions.
Whenever practical, a concern should first be directed to the staff member or department involved so that the issue can be reviewed at the appropriate operational level. If the matter is not resolved, it may be escalated through T & K's appropriate chain of command.
T & K may review order records, proofs, payment information, photographs, communications, physical products, staff notes, and other relevant documentation before determining an outcome. T & K will use reasonable discretion to determine an appropriate resolution consistent with these terms and applicable law.
19. Nondiscrimination & Accessibility
T & K Designs and Services is committed to providing respectful service and does not discriminate on the basis of disability or other status protected by applicable law.
Customers who need a reasonable accommodation to access T & K services, ordering processes, or events may contact T & K to discuss the request. Accommodation requests will be considered based on the circumstances and applicable requirements.
20. Right to Refuse or Cancel Work
T & K reserves the right to refuse, decline, suspend, or cancel a request or order when reasonably necessary, including when a request cannot be produced appropriately, safely, lawfully, or within available business capabilities; when required information or payment is not provided; or when circumstances materially change before production.
If T & K cancels an order for reasons unrelated to customer conduct after accepting payment for unproduced goods or services, T & K will determine the appropriate handling of amounts paid consistent with the order status, these terms, and applicable law.
21. Delays & Circumstances Beyond Reasonable Control
T & K is not responsible for reasonable delays caused by circumstances beyond its reasonable control, including severe weather, carrier disruptions, power or internet outages, equipment failures, supply shortages, vendor delays, emergencies, event changes, or other comparable circumstances.
T & K will make reasonable efforts to communicate material delays when practical.
22. Errors, Omissions & Reasonable Corrections
T & K may identify and correct genuine typographical, clerical, pricing, technical, website, catalog, communication, or other inadvertent errors.
T & K uses reasonable discretion to determine whether an error has occurred and to determine an appropriate correction or resolution, consistent with applicable law. A correction or courtesy accommodation does not create an obligation to provide the same outcome in a different matter.
23. Updates & Modifications to Terms and Business Policies
T & K reserves the right, at its discretion, to add to, update, revise, or modify these Terms & Conditions, related policies, and business practices without prior notice, except where notice is required by applicable law.
Changes apply prospectively. The version of the Terms & Conditions in effect when an order is placed will generally govern that transaction unless the parties agree otherwise in writing or applicable law requires a different result.
24. Governing Law, Severability & Entire Policy Framework
These Terms & Conditions are governed by applicable law in the State of Georgia.
If any provision is found unenforceable, invalid, or unlawful, the remaining provisions will continue in effect to the fullest extent permitted by law.
These Terms & Conditions work together with any product-specific instructions, written quote terms, proof approvals, care instructions, event rules, shipping instructions, and other written T & K policies applicable to the customer's order. When a specific written term expressly applies to a particular order, that specific term may supplement these general terms.
Customer Acknowledgment
By placing an order, submitting a paid quote or design request, approving a final proof, or completing a purchase with T & K Designs and Services, the customer acknowledges that they have had access to the applicable Terms & Conditions and agrees to the terms governing the transaction.
